Terms of service
The terms on which a restaurant uses Anty Food
1. The service
Anty Food lets you take orders from your own customers on WhatsApp, on a storefront website we provide on your own address, and at your counter; shows them to your kitchen; dispatches riders; collects payment through a licensed payment company; and keeps your customer records, inventory and sales figures in your own dashboard. We may improve or change features; we will tell you before removing one you rely on.
2. Your account
You must be a business able to sell food lawfully, and keep your menu, prices, opening hours and bank details accurate. You are responsible for what is said and sold under your name, for the people you give sign-in access to, and for keeping their sign-in codes and counter PINs private.
3. Charges
- Commission: 14% of the food value of each order placed and paid through the service. Not charged on delivery fees, and never charged on an order that is refunded.
- Platform fee: ₦30,000 a month, flat, per restaurant, invoiced monthly.
- What we do not charge: no setup fee, no markup on your menu prices, no markup on your customers’ food, no commission on delivery.
- What the customer pays: your menu price, the delivery fee, and a 7% service fee on the food value, each shown as its own line at checkout. The delivery fee goes to the rider less the 5% that funds rider cover and waiting allowances.
- Multi-branch chains are priced by arrangement in writing.
If a charge changes you will hear from us in writing before it applies, and you may stop the service before it does.
4. Payments and settlement
Customers pay through a licensed Nigerian payment company. Each order’s payment is split at the point of payment: our commission comes off and your share settles to the bank account you registered. Money does not sit with us and we do not pay you on a cycle. The payment company’s own terms apply to the collection and to any dispute about a payment; a daily statement in your dashboard lists every order settled.
5. Refunds and orders that go wrong
If an order never arrives or is wrong, the customer is refunded in full and the refund comes off your share, with the reason recorded against the order, unless the fault was our rider’s, in which case the delivery fee is ours to lose. The published refund policy shown to customers at the time of the order governs each case.
6. Riders
Riders on the service are independent couriers who accept jobs from the kitchen screen; you may also use your own. A rider is paid the delivery fee for each delivery completed. We check a rider’s identity before they carry orders.
7. Your customers and your data
Your customer records (names, numbers, orders, consent) are yours. We process them on your instructions as your data processor under the privacy policy, keep them in your dashboard, let you export them at any time, and do not use them for any other restaurant or purpose. You are the data controller for your customers and must use their data lawfully: in particular, you may send offers only to customers who have said yes through the service, and must honour a STOP.
8. Acceptable use
You may not use the service to sell anything unlawful, to send unsolicited messages, to mislead customers about prices or availability, or to interfere with the service or another restaurant. We may suspend an account that does, after telling you why, and will lift the suspension when the matter is put right.
9. Ending the service
There is no fixed term and no notice period. Stop paying the platform fee and the service stops at the end of the paid month; you may export your customer list before and after. We may end the service with thirty days’ notice, or at once for a serious breach, and will settle what is owed to you either way.
10. What we promise, and what we do not
We will run the service with reasonable skill and care and keep it available as far as we can, but it depends on WhatsApp, the payment company and the internet, which we do not control, and it is not guaranteed to be free of interruption. We are not liable for loss of profit or for indirect loss, and our total liability to you in any month is limited to the charges you paid us in that month. Nothing in these terms limits a liability that cannot be limited under Nigerian law.
11. Law
These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Lagos State have jurisdiction, after both of us have tried in good faith to settle a dispute between ourselves first.
